Adding House Rule No. 105a, relating to requiring that bills
imposing a tax or license fee and bills increasing the
effective rate of any tax levied or fee imposed may not be
enacted unless two thirds of the elected members of the
House of Delegates vote in the affirmative for passage.
Resolved by the House of Delegates:
That House Rule No. 105a be added to read as follows:
Passage Of Bills Containing Tax Or Fee Increase
105a. Beginning with the Legislature for the year one
thousand nine hundred ninety-eight, each bill imposing a tax or
license fee or increasing the effective rate of any tax levied or
fee imposed may not be enacted unless two thirds of the members
elected to the House vote in the affirmative for passage.
The House may, by a simple majority vote of the members
present and voting in the affirmative, enact a bill to impose or
increase a tax or fee as necessary to ensure that funds are
available to pay the principal and interest on state debts when
due and payable or a bill designed to bring state tax laws into
conformity with federal tax laws. The House may not enact any other bill to increase taxes or fees by simple majority vote.
NOTE: The purpose of this resolution is to require that
bills imposing a tax or license fee and bills increasing the
effective rate of any tax levied or fee imposed may not be
enacted unless two thirds of the elected members of the House of
Delegates vote in the affirmative for passage.
